People should be pissed off that he puts himself above the team through his behavior, instead of defending him. So, hell yeah. I am angry

805 said what many of us feel. then the defenders demand to know what other incidents he has been involved in. posters point them out but its like they are just pissin into the wind. the foster defenders or foster denials are very strong

While I agree to most of what all of you have said, especially the bit about blind defending of a player without knowing the details.

I can see an immature, troubled young man, who loves football and his teammates, and his teammates love him, I think that shows he isn't a bad person at heart.

I really think he'll never give us any trouble in the season, but yes I'm worried about him in the offseason.

He makes terrible decisions and seems to have anger and control issues, but I'm not giving up on him yet, he has the outlet of football in season, he needs to find one in the offseason.

I don't know - he's made some mistakes, but this situation is all about his girl friend. She's the one who concocted this whole thing.

i think it is perfectly reasonable to be wary of waking up every sunday morning and seeing foster doing something bad on saturday night. did that with aldon all the time

*IF* the truth is that he didn't hit her, then I agree - I'd pursue a trial on both a moral and ethical point of view to exhonorate himself. But if the *truth* is that he did hit her (in some fashion - and only he would know that in his heart of hearts) I'd settle. First of all, it's more a buisness decision than a legal or moral decision at that point. If he can plea down the charges, he has a good chance of getting back on the field with the 49ers before somebody takes his job permanently. Uncertainty is bad for business, that's why businesses always settle if the uncertainty materially affects their business, even though the truth is that they are not guilty and the facts are arguable.

Reuben still has the Alabama drug issue and he's still on Goodell's substance watch program (as far as I know) and he's running out of *get out of jail cards.* He is lucky the Victim is recanting her testimony in the DV issue, I don't know if he'll be as lucky in the Alabama case - ie from an evidence point of view. He has potential technical violations both in obstruction of justice and a firearms charge here in Calif. - those don't go away even with the Victim's recantation. If he does proceed to trial, he potentially will have to appear on both cases and attorney's aren't cheap, specially if they are good. If he settles, both sides can stipulate to not reveal more information than what is already on public knowlege - that protects him from Goodell's investigations with regards to the NFLconduct policy. That eliminates one legal case and he can concentrate on the Alabama issue and possibly plead that down to a lesser charge too. Then once the Alabama case is settled, he can focus on his appeal of his possible suspension from the NFL. Fighting a 3 front war and still trying to play football is not the best strategy to keep his job and play well, in my opinion.

The gun charge will be at most a fine and the gun gets taken away.
And the weed, I've read here it's a 2nd degree charge which is just having some weed (not a lot) in his car. He hasn't tested positive for weed as of now

A good friend of mine is a cop in Tuscaloosa, no he wasn't the one who arrested Foster, but I asked him and Alabama law is that at 2nd degree it was less than 2 ounces IIRC.

If both of you are right, then I think the DA would be amenable to a settlement (or should be considering the negative publicity that might happen to him and his office, if the DA loses the case to Reuben), ie possibly drop all charges in exchange for community service/public service kind of penalty. Or, as 49ersATT said, a fine and loss of the gun. Same with the Alabama case, from a business point of view (not a legal point of view), Reuben should do his best to pursuade the DA to be lenient and settle it with him. As of right now, the DA has no case against Reuben on the DV issue with the DA's main witness so hostile to the DA.

As for the gun violation, this is not Aldon Smith...who had a gun in his suitcase or something like that in the airport. Another time he said the word BOMB in the airport and someone, a law enforcement or TSA guy, heard him. Also Reuben is not the NYG WR(?) who carried a gun into a bar/nite club and then proceeded to shoot himself in the groin. (Really). Reuben is a guy from another state having a weapon in his house . So the DA can run with this gun violation all he wants but this is an entirely different kettle of fish from the Aldon gun episodes. Also another time Aldon had a party , it got out of hand and he touched off a cap in the middle of all the revelers. (Really). again, this was NOT Reuben.

Now, if the DA really has no case with the recant, and i were Reuben's atty, i would certainly consider mentioning to him that his client just wants this to go away, and he will have no intention of saying anything about the case nor the DA in public....which if Reuben did nothing wrong, he might make some verbal complaints about the DA later. IF i were reuben's Atty, i would tell him Reuben just wants this behind him and not a word gets repeated hereafter. Just want the DA to know that and that there are no hard feelings in an otherwise bizarre case.

Also i would repeat the Aldon episodes and let the DA know that this is NOT Aldon #2.

Then, i think ,i would go home and start saying the beads..and hope this goes away. Also as has already happened, Reuben just needs reminding if he even J walks again he is adios. And not just from here but anywhere. Then, i think, i would go home and repeat saying the beads.
