Haven't heard that rule. The rule I heard was once it's opened, the team has to activate him within three weeks.

Once opened you can activate them immediately that week if you want

I may be mistaken, but I believe for a player to come back from IR - the team has to open the practice window and be convinced the guy is able to play. it gives the team time to make sure they're ready before opening a roster spot.
He won't be back this week but if they beat Seattle they might seriously start to consider getting him ready so he's available for the SB if they get that far.

Unless the 49ers truly are considering playing Fred, he seems to be sort of a distraction with all of this drama.

If he feels ready to play, he should be out there. Tape that sucker up and go.
Fred say he's ready to go RIGHT NOW

They should at least let Fred start to implement himself back into the system. Let him get 10-20 plays this week and then ramp it up to 30-45 next week and then full go for the Super Bowl.
