Elliott could also get his injunction stayed while the request is considered. It means he could potentially play as the the legal process draws itself out. There's no guarantee Elliott's appeal is granted after the same court ruled against him. As of now, Elliott is set to be suspended through Week 12.

There's a lot of confusion about the next steps. From what I understand they first have to ask the court for a hearing, if the court agrees to hold a hearing, THEN they could have a temporary injunction in place to allow Elliot to play, while the hearing is scheduled.
The court very rarely grants these hearings. Last year out of 200 rehearing it granted 11. A rehearing requires ALL of the judges to be present; all 15 of them. I highly doubt the court will gather up all the judges to hear a CBA dispute. This is not a case that will have ramifications for the general public. Most likely outcome is that he serves the 6 games, starting in SF.
