Its not his character name from WWE. He owns the copyright on that name since his days on the indy circuit. Its his "brand" and he prefers to be called that when he's out in public. Plus its easier for the UFC to market a fight for "CM Punk" than "Phil Brooks." Casual wrestling fans would know the name CM Punk and check it out but if they just read Phil Brooks on the card they wouldn't know who it is and just ignore the PPV.

Yeah its really unheard of for that time period. I don't know how he pulled it off. The WWE seems to be more ok with guys keeping their Indy/TNA names now with guys like Samoa Joe, AJ, and Austin Aries, but guys like Bryan Danielson got screwed. lol
