The teams can talk about trades all the time, so not surprising that trades happen as soon as they open.
An unrestricted free agent by definition can also hold discussions with teams. They, by definition, are unrestricted free agents because their contract has ended and they are no longer under contract so they are free to talk with who ever they want to. Same with undrafted free agents. No restrictions there.
It is restricted free agents and players under contract that cannot hold such discussions. Teams can hold discussions between themselves about restricted free agents and players under contract. Teams can also grant permission to another team for such discussions (this is done if the team wants to do a trade and the other team wants to renegotiate the contract to make sure that it will happen if the trade occurs)
By the way the penalty when such a discussion takes place is not against the player, it is instead against the team that conducts such discussions. As such teams do stay away from such discussions.
