I would usually say 'business is business,' but in this case, Smith re-structured his contract a few years ago to help the team out. I don't think the team will even think of asking for that money.

Yes, get the money back since his contract is not fulfilled. BUT,,,no one ever said York's can't give it to him as a "gift." We all know cheap-a$$ York would never do that, but if this was in the day and age of Eddie D....Justin would have an envelope waiting for him. But as another poster mentioned, they would be in trouble for cap fraud.

This. Neither he nor the 49ers management expected him to make it through the whole contract, that money is his to do whatever the heck he wants with it, he earned it.
