Franklin is not considered a holdout because he is not under contract to any team.

A draftee, while not under contract, is selected by a specific team, so even though a draftee is technically not a holdout for not signing a contract, he is treated as one. Not so with veterans.

As a matter of fact, Kukura is the only "sports writer" (again, I use the term loosely) to call Franklin's not showing up a "holdout".

Actually if he is not under contract to any team Franklin is a Free agent thus can sign with any team, but he can't cause the niners still own his rights, they franchised him and tendered him an offer. He did not sign the tender and is holding out cause he wants a long term deal with guarenteed money. While he can sign with another it has to be better than the 7+ mill the niners tendered and will cost the other team some first rounder.

He can sign the deal as is or the niners can still offer him a long term contract, the tender and franchise was just to set the bar and own his arse.

Why get in a huff over such small verbage, technically he is holding out for more more money/years, but probably also so he won't injure himself.

Semantics

He is keeping himself away from the team during training camp because of contract situation. It's the exact same thing except that he's not a rookie and is a veteran. IMO getting irritated or questioning a writers abilities over it is silly.

Exactly! - "Semantics" - The bottom line is that Franklin is not in camp, which totally sucks, and you cannot fault a journalist/sports writer or whoever it is to try and lure readers to dive into their columns with some sensationalistic headlines. After all, isn't that what they're paid to do? Don't get me wrong, there are some major writers that are douches, but I agree with the above poster WINiner that said, "...getting irritated or questioning a writers abilities over it is silly." I'm more pissed that Franklin is not in camp than what Kukura is writing about.

Actually, the 49ers cannot offer Franklin a multi-year contract at this point, according to league rules. The deadline for doing so has passed. The 49ers cannot negotiate a long term contract with Franklin until after the 2010 season.

That's why this is not a holdout in the truest sense; Franklin can gain nothing by waiting to come to camp, except that he reduces the risk of injury in what amounts to a contract year for him.
