No he's not. This incident happened in December. The 49ers knew this was a possibility, and if they couldn't handle it, they would have released Brooks then. They're going to let the process play itself out and deal with any discipline Brooks receives.

Should have traded him this offseason. Now we get nothing for him. And please cut him... we need to weed out the rest of the distractions. Side note why did we bring in Simpson and Dockett if we wanted to win with class and get rid of the distractions. At least Dockett's isn't criminal but he's dumb.

We need to move on, we have had enough problems this offseason and we cant be having stuff like this a few weeks before our first game. Weed the rest of the distractions out and get on with the 1st game.

Exactly. SF/Baalke would have released Brooks in the offseason if they were going to do it for this incident.

As it stands, I suspect SF will treat it like the Simpson situation: let the legal system and the league handle it.

I expect Baalke to make a statement that they've been aware of the situation and possible charge since the incident, and they discussed how to move forward with Brooks this past offseason, and feel that he's making the correct strides to move forward from the incident, allowing the legal course to proceed as it will.

Damn, was hoping the rumor another poster told me wasn't true. Apparently there is video or photos of the incident. Now it just means Lemonman makes the team ugh… when will the sh*t storm end
