The San Francisco 49ers released the following statement regarding linebacker Ahmad Brooks remaining with the team.
"We have been in close communication with the league and a preliminary status decision has been made regarding Ahmad Brooks. Ahmad will remain on the active roster. In addition to the steps the organization has taken to this point, both the judicial and the league process under the Personal Conduct Policy will continue. This processes will dictate any further action."
In August, a Santa Clara County Grand Jury has charged Brooks with one count of misdemeanor sexual battery. They had also charged former 49ers defensive lineman Ray McDonald on one count of raping an intoxicated woman following a party at his house in December. Among the claims within the lawsuit was that Brooks had groped her in a "sexual manner" while she was unconscious.
NFL statement: Based on its investigation to date, no basis for placing #49ers LB Ahmad Brooks on Commissioner's Exempt List.
