That does not mean that Kaepernick or Griffin are headed to the CFL. It just means that, should either decide to play in the Canadian league, the Tiger-Cats hold their rights.

On March 3, Kaepernick officially opted out of the final year of his contract with the 49ers and became a free agent on March 9. Had Kaepernick not opted out of his contract, it was very likely that the 49ers would have cut the quarterback because of his $14.9 million due heading into the 2017 season.

According to 49ers general manager John Lynch, an NFL team came close to signing Kaepernick in the opening days of free agency, but the deal apparently fell through.
Kaepernick, who is still just 29 years old, was drafted by the 49ers in the second round of the 2011 NFL Draft after playing college football at Nevada. In 2012, during his first year as a starter, the quarterback helped lead the 49ers to a Super Bowl after taking over for an injured Alex Smith and never relinquishing the job.
In 2016, Kaepernick completed 59.2-percent of his passes for 2,241 yards, 16 touchdowns, and four interceptions through 11 games. The 49ers have seemingly moved on from Kaepernick and have signed former Chicago Bears quarterbacks Brian Hoyer and Matt Barkley. The team is also expected to draft a quarterback in the 2017 NFL Draft, which kicks off on April 27.
