In August, Smith was booked at Santa Clara County Jail for an alleged hit and run, a DUI (which he denied), and vandalism.
According to a police affidavit of Smith's arrest, an argument led to the 49ers linebacker hitting a neighbor's car - resulting in minor damage.
Smith, who started last season on a nine-game suspension, was released by the 49ers the day after his August arrest, following his release from jail.
The talented 49ers linebacker has had numerous other incidents including a shooting at a 2012 party at his house, another DUI, and yelling 'bomb' at Los Angeles International Airport.

On the same day as his signing with the Raiders, Smith has been charged with three misdemeanors. They include a DUI with prior conviction and refusal to submit to chemical test, a hit and run with property damage, and vandalism under $400. His arraignment is set for October 6.
