He was arrested last night for an alleged hit and run, DUI, and vandalism. Bail has been set at $26,000.
Smith, who started last season on a nine-game suspension, is entering is final year of his contract with the 49ers worth $9.75 million.
The talented 49ers linebacker has had numerous other incidents including a shooting at a 2012 party at his house, another DUI, and yelling 'bomb' at Los Angeles International Airport.
In the past, the NFL used to wait until the legal process is complete before making any judgement on players. Of course, now the NFL can look into the situation themselves if they wish and make a judgement based on their own findings.

According to The Mercury News, Smith has posted bail, reportedly apologized, and said that there was no DUI involved.

"I want everybody to understand this wasn't a DUI. The situation that happened could have been handled differently," said Smith in the interview.
According to Mike Silver of Sports Illustrated, the Jed York and the 49ers have not yet made a decision on what to do with Smith.

Robert Handa of NBC Bay Area is reporting that, according to a police affidavit of Smith's arrest, an argument led to the 49ers linebacker hitting a neighbor's car - resulting in minor damage.
