On January 12, the 49ers linebacker was arrested in Alabama and charged with second-degree possession of marijuana. Unlike the felony charges stemming from his most recent arrest, the marijuana charge is a misdemeanor.
Tom Pelissero of NFL Network reported on Friday that Foster is due in court on June 20 for his initial arrest.
The 49ers have a mandatory minicamp scheduled for June 12-14. Foster, however, has not participated in team activities since the charges from the second arrest were announced and is unlikely to do so until the situation approaches a resolution. The 49ers have taken a patient approach by letting the legal process progress before making any decisions concerning the linebacker's fate.
The NFL is likely to launch its own investigation into the incident, and Foster is still facing potential suspension. NFL spokesman Brian McCarthy told Bay Area News Group that the league is "monitoring all developments in the matter."
The case took a turn on Thursday when the alleged victim, ex-girlfriend Elissa Ennis, severely damaged the Santa Clara DA's case against Foster by testifying that the charges against the linebacker were all based on her lies. Ennis admitted to trying to ruin Foster's career after the linebacker broke up with her, stated that Foster never struck her, and revealed that she had previously served time in jail for falsely accusing a former boyfriend of domestic violence.
"I wanted to sue Reuben," Ennis said. "It was all a money scheme."
