Panthers have the tie breaker because they beat us head to head which is the first tie breaker so they have to lose for us to move into the #5 spot

Yup. You are correct.
There is no tie-breaker as long as we win out. One of them will have their 5th loss after today. As long as we win our last two games, we will only have 4 losses and the 5th seed. Tie-breaker only comes into play if we lose again

I can't believe the refs didn't throw a flag because brees was sacked too hard.
