Because he's an unrestricted free agent.

I would hope that the 49ers coaching staff is smart enough to exclude guys like Tolzien, and all of the bubble players, from meetings regarding their Week 1 opponent. Or keep them out of any gameplan meetings that occur during camp. Surely they know that some of these guys won't make the team and it'd be really dumb to keep guys like Tolzien well informed so that when he gets cut he can run to the Packers or Seahawks and tell them what the 49ers are planning to do.
Honestly, I think most NFL coaches are smart enough to do this and when teams pick up guys they don't typically get any real useable intel.

Ha, that team is desperate to beat the 49ers. Honestly though, I'm not surprised. If they lose 3 times in a row to the 49ers the fans will be calling for someone to get fired... if the 49ers end up winning 4 games in a row and knocking them out of the playoffs 2 years in a row, the fans will be putting a lot of pressure on the team to fire either McCarthy or Capers.
Tolzien will give them a lot of good inside information on Roman and Harbaugh and how they think... he has been in the system for 2 full years and a 3rd offseason this year. I'm sure he has some good intel. Although it doesn't matter, I mean, Capers worked with Fangio for years and hired him as his DC in both Carolina and Houston... that didn't help McCarthy beat Fangio's defense.

When exactly does the team begin installing the week 1 game plan?
I am not sure Tolzien has any information about the game plan for Green Bay.
Is it possible that this signing players as an intelligence gathering tool is more of a urban myth than a real occurrence?
I do not really know.
